Terms and conditions

§ 1   GENERAL

1.1. These general terms and conditions (GTC) apply to all trainings organized by “Lifeliners”,domiciled at am Jungenwäldchen 41, DE 66663 Merzig, Germany, owned by W.C.J.F.M. Barendse – van den Eeden and any organization or company making a request for a training organized by LifeLiners (hereinafter: “Client”).

1.2. The Client’s request for training(s) must be made in writing. This condition is fulfilled by using the booking form on the website or in case of malfunction of the online booking tool, by sending an email to info@lifeliners.eu. Subsequent changes and or additional agreements must be made in writing by emailing to info@lifeliners.eu.

1.3. Services are provided exclusively in accordance with these GTC, unless the parties agree in writing on a specific agreement. In addition to these GTC or a specific agreement, the written order confirmation shall determine the scope and performance of the trainings.

1.4. Acceptance of these GTC without objection shall be deemed to be the Client’s consent, even if the Client excludes recognition of other terms and conditions in its own GTC. The terms and conditions also apply to future trainings and or related services.

1.5. These GTC may be modified or supplemented at any time, without notice.

 

§ 2   CONCLUSION OF CONTRACT

2.1. Written registration is required for providing the training courses. This registration must be sent to “Lifeliners” in accordance with § 1.2 in advance of the start of the training course.

2.2. Registrations are binding after the acceptance of LifeLiners. The contract is concluded by:

  • the Client’s written registration;
  • the Client’s confirmation at the latest 5 weeks (25 working days) before the start of the course on the basis of the signed cost estimate, otherwise the date(s) of the course(s) are deemed to be canceled. Unless LifeLiners has accepted a last-minute registration, the 5-week deadline does not apply.

2.3. The GTC’s become part of the Contract between the Client and LifeLiners with the registration.

2.4. The contract only establishes rights and obligations between Lifeliners and the Client.

 

§ 3   FEES

3.1. All stated prices are before-tax prices excluding VAT.

3.2. LifeLiners’ courses are an all-in price up to a maximum of 6 or 10 Participants depending on the chosen training, there is no minimum participants restriction applicable.

3.3. Prices include certificate fees, training materials, travel costs within a 20 km radius from Luxembourg city.  In case travel distance exceeds 20 km from Luxembourg city additional travel expenses of 100.00 EUR, excluding VAT, per course, will be charged. No training will be held outside the territory of the Grand Duchy of Luxembourg.

3.4. Payment is made against receipt of the invoice. These invoices are due immediately upon invoicing and payable without discounts. No cash or credit card payment is possible.

3.5 The course fee must be transferred in advance to the following account, indicating company name and invoice number on the payment notice:

3.6. A 12.50 EUR, excluding VAT, reminder fee will be charged per reminder.

 

§ 4   WITHDRAWAL / CANCELLATION

4.1 A cancellation by the Client can only be made in writing by email to info@lifeliners.eu  and might become subject to a cancellation fee in line with the table mentioned in § 4.3. For a successful cancellation the Client will provide the complete information, company and course name, class date, required for processing. LifeLiners is under no obligation to verify the accuracy of the information in emails. Any cancellation will be confirmed by LifeLiners.

4.2. The deadline will be calculated based on the date LifeLiners receives the written cancellation.

4.3. Cancellation fees will be charged as mentioned below:

4.4. The cancellation fee must be transferred to the following account, indicating company name and invoice number on the payment notice:

4.5. A training might be cancelled or rescheduled by LifeLiners if the course leader becomes unavailable in case of sickness, disability or is otherwise incapacitated. LifeLiners will use all means at its disposal to ensure that the course will take place or to postpone it. If this is not possible, the course will be cancelled and the Client will be informed by email. In case the course cannot be rescheduled to another time, the course fee will be refunded. The Client is not entitled to another compensation.

 

§ 5   RESCHEDULING OF A TRAINING

5.1. If due to unforeseen reasons, a Client wishes to reschedule or postpone a course to a future date, rescheduling is possible. Please note that rescheduling is subject to our availability of the proposed new date.

5.2. To reschedule a training a request should be directed to info@lifeliners.eu at the latest 10 days before the original agreed date between the Client and LifeLiners. In this request the following  information should be provided:

  • company name;
  • name of the course;
  • original course date;
  • three new preferred dates, each in a different week.

5.3. Rescheduling fees will be charged as mentioned below:

§ 6   ON-SITE / NEARBY VENUE

6.1. The in-house or nearby venue should be a public building, company premises or a school.

6.2. The Client provides a suitable training venue of approximately 50 m² for a maximum of 10 Participants to be instructed in theoretical and practical trainings.

6.3. LifeLiners will confirm whether the proposed in-house training area is suitable for holding the training session(s). If the location is not deemed suitable, the Client will propose an alternative location within a reasonable period of time. LifeLiners will provide guidance based on the number of participants as well as the requirements for a suitable training location. If no suitable location could be provided in-house at the Client’s premises, training can be held at a hotel, external conference room, or any third-party location organized by the Client at his expense.

6.4. The rooms must have sufficient lighting and ventilation. In addition, seating and writing facilities as well as washing facilities and toilets should be available.

6.5. Furniture, cabinets excluded, should be movable and not impact the course. If possible, remove furniture not to be used for the course, such as redundant tables and chairs, from the room to create a safe open space for hands-on practice sessions.

6.6. The venue should be open to the trainer one hour before the course starts.

6.7. If the instructor determines upon arrival at the training venue that the room provided does not meet the above requirements, the training can be cancelled without reimbursement of course fees or eventual travel expenses.

 

& 7   TRAINER SUPPLY, EQUIPMENT AND REQUIREMENTS

7.1. Parking should be made available for the trainer to use for the duration of the course, and space to safely unload equipment. If parking is not available, a loading bay or other suitable space must be made available by the Client for the trainer to unload equipment.

7.2. Trainer has access to free internet. The Client provides a computer with an USB port, free internet access and connection to the projector.

7.3. LCD projector with a white screen or alternatively a blank white wall for slide shows must be able to be used. Flip chart or white board with pens are made available.

7.4. A chair and table are at the trainer’s disposal. Drinks and a lunch, where relevant, will be provided by the Client.

7.5. In the event of force majeure, e.g. severe weather conditions, the Client organizes an overnight stay for the instructor and covers this cost including a meal and breakfast.

 

§ 8   SUITABILITY, TRAINING ASSESSMENT AND BEHAVIOUR ON OUR COURSES

8.1. The Client will select qualified employee(s) for participation in the training (“Participant(s)”).

8.2. LifeLiners has an equality and diversity policy, and we welcome participants with disabilities. Still, it is the Client’s or Participant’s responsibility to ensure that they are given the support to perform the duties of a first aider to the approval of the safety officer (travailleur désigné).

8.3. The duties of a first aider can be physically demanding. For certification, a Participant must be able to meet our assessment criteria by demonstrating their skills during practical course assessment. They must be able to kneel on the floor to administer CPR and put a casualty into the recovery position. Unfortunately, we are unable to certify a Participant if they do not complete all practical assessments as per the compulsory criteria.

8.4. It is both the Participant’s and the Client’s responsibility to ensure that required physical criteria, as described above, can be met in order to participate on the chosen course. No full or partial reimbursement of course fees is applicable for participants who participate in a course but do not meet these criteria.

8.5. Participants must actively participate in all elements of the training course for him or her to receive a diploma or certificate. A Participant who fails to attend the full teaching hours, fails to participate and does not pass all assessments will not be certificated.

8.6. A Participant needs to have a basic command of English, German or Dutch (defined as level 2), depending on the chosen language, to complete LifeLiners’ trainings. Learners with limited command of English, German or Dutch need to contact us to discuss any arrangements that can be made.

8.7. Participants must be aged 12 years or older.

8.8. LifeLiners reserves the right to refuse course entry or ask a Participant to leave a course in the event that:

  • the person does not arrive on time, leaves during the course, or is absent during (parts of) the course;
  • the person behaves inappropriately or unprofessionally;
  • the person refuses to participate in all elements of the training;
  • the person is under the influence of drugs and/or alcohol.

 

§ 9   DIPLOMA / CERTIFICATE OF ATTENDANCE

9.1. Upon completion of the course, each Participant receives a diploma or certificate of attendance, depending on the type of training.

9.2. The issuance of the diploma or certificate of attendance is conditional upon:

  • a complete participation in the relevant course: attendance of the full teaching hours, passing of all theoretical and practical assessments;
  • signature of the individual Participant on LifeLiners’ list of participants, validated by the instructor;
  • full payment of the training fee.

9.3. For issuance of a duplicate diploma or certificate of attendance, an application shall be addressed to info@lifeliners.eu. containing the following information:

  • full first name(s) and surname;
  • date of birth;
  • company name;
  • exact course date;
  • course name.

9.4. Duplicate certificates for the current year will be issued at a fee of €18.50 excluding VAT, for previous years at a fee of €22.50 excluding VAT. The fee must be transferred in advance to the following account, indicating your full name, company name and the term “duplicate certificate” on the payment notice:

9.5. If you request a duplicate diploma or certificate of attendance, please verify that you actually completed the training at LifeLiners. In case you did not complete the training at LifeLiners, we cannot refund the fee mentioned in 9.4. due to the processing costs incurred by us.

9.6. In the event of typos or spelling errors made by LifeLiners, the Client is entitled to a corrected newly issued certificate free of charge within 4 weeks of delivery to the Client or Participant. If this period has elapsed, a processing fee of € 18.50 excluding VAT will be charged.

 

§ 10   COPYRIGHT

10.1. Accompanying workbooks, documents, presentations etc. for training courses are subject to copyright and may not be reproduced by photo or electronically copied at any time or under any circumstances. They are intended exclusively for the personal use of the training participants and may not be passed on to third parties.

10.2. Documents and presentations that may be made available on the website of “LifeLiners” or a contractual partner are also subject to copyright. A download is only intended for information purposes and for personal use. Reproduction or forwarding to third parties is prohibited.

 

§ 11   WEBSITE – GENERAL

11.1. The website www.lifeliners.eu  and its contents are the property of LifeLiners, whose registered office is located at am Jungenwäldchen 41, 66663 Merzig, Germany.

11.2. The website is hosted by the company STRATO GmbH, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany.

 

§ 12   WEBSITE – USER OBLIGATIONS

12.1. Any person using the information, documents, applications or services provided on the website www.lifeliners.eu shall be deemed to be aware of, and to have accepted, all the provisions of these general terms and conditions of use.

12.2. Use of the website, www.lifeliners.eu, is free of charge.

12.3. The website is accessible via internet. The user declares that they are aware of the paired risks involved and accept those risks. The user must guard against the effects of computer hacking by implementing suitable and secure computer configurations.

12.4. The user undertakes to use the website in good faith, not to infringe the rights of LifeLiners or eventual partners and not to harm them.

12.5. In particular, the user undertakes not to damage the reputation, defame, insult, harass or threaten LifeLiners, eventual partner of LifeLiners or a third party and not to use any device, sub-program or software that could harm the proper functioning of the website.

 

§ 13   WEBSSITE – CHANGES TO THE SITE

13.1. LifeLiners reserves the right to develop, modify or suspend the website, without prior notice, for maintenance, updating purposes, changes in legislation or for any other reason which may be deemed necessary.

13.2. In particular, LifeLiners may, at any time, withdraw, add to or clarify all or any part of the information and services contained in or offered on the website. LifeLiners may not be held liable for any loss or damage whatsoever, whether direct or indirect, in connection with any such modifications.

 

§ 14   WEBSITE – GENERAL LIMITATIONS OF LIABILITY

14.1. LifeLiners will use its best endeavours to ensure that the website is maximum available. However, it accepts no liability should the website become temporarily or wholly unavailable.

14.2. LifeLiners will use its best endeavours to ensure the security of the IT system to the best of its ability. However, in the event of an attack on the IT system LifeLiners cannot be held liable.

 

§ 15   WEBSITE – LIABILITY LIMITATIONS OF THE PORTAL

15.1. LifeLiners expressly cannot accept liability for any consequences, whether direct or indirect, arising from:

  • Incompatibility between the service offered and the equipment, applications, procedures or infrastructures of the user or of any third party;
  • Any security breaches caused by the user or a third party, and more generally any security breaches not directly attributable to the website;
  • Any errors and/or fraudulent acts committed by the user or a third party;
  • Any unavailability or malfunction of electronic communication systems or networks.

15.2. LifeLiners accepts no liability for any loss or damage which the user may suffer, directly or indirectly, in connection with browsing on the website or using the services which it offers.

15.3. LifeLiners will use its best endeavours to ensure that the information published on the website is accurate. However, it may not be held liable for any omissions in connection with the update of information or forms, errors in the use of the system, coding errors or inaccuracies, or gaps, errors or inaccuracies in the information provided. The aim is to disseminate accurate, up-to-date information that may emanate from a variety of sources, but LifeLiners is unable to avoid all risks of hardware error.

15.4. None of the information published on LifeLiners’ website should be considered as exhaustive or as a commitment. Explanations in layman’s terms and translations are provided solely for information purposes. The information appearing on this website is of a general nature.

16.1. The website, all the elements contained therein (including the layout), and the information and services are protected by the relevant intellectual property and copyright laws.

16.2. Unless otherwise specified, lifeliners.eu grants no license or authorization with regard to the intellectual property rights which it holds in respect of the website, the elements it contains, or the services. Moreover, reproduction of the information or services, either in full or in part and in whatever form or by whatever means, is forbidden without the prior written consent of LifeLiners.

16.3. Unless otherwise specified, users are authorized to view, download and print the available documents and information, subject to the following conditions:

  • the documents may only be used for personal purposes, for information and in a strictly private context;
  • the documents and information may not be modified in any way whatsoever;
  • the documents and information may not be disseminated outside or beyond the website.
