Privacy Statement

§ 1   GENERAL

1.1. In accordance with the provisions of EU Regulation No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter “GDPR” (General Data Protection Regulation) ) and any applicable national data protection laws, we are required to collect, store and process some of your personal data (hereinafter “personal data”) in the course of our business.

1.2. When we process your personal data, we are acting as controller and are required to inform you of the terms of our processing and of your rights under the GDPR.

 

§ 2   WHO WE ARE

2.1. We are LifeLiners, an on-site and in-house First Aid Training Specialist for companies and organizations across Luxembourg.

§ 3   COLLECTION AND PROCESSING OF PERSONAL DATA

3.1. By entering your data via LifeLiners’ dedicated online form, by e-mail at info@lifeliners.eu, or by telephone, you consent to the collection and processing of your personal data.

3.2. In accordance with the principle of data minimization, we only collect personal data that is strictly adequate, relevant and limited to what is necessary for the purposes for which it is processed. It is based on one of the lawfulness grounds provided for in the GDPR. We process your data if:

  • you have consented to it, in accordance with § 3.1.;
  • the processing is necessary for the preparation and performance of an agreement between the Client and LifeLiners and to comply with further obligations arising therefrom, in particular in terms of invoicing, participation list, issuance of diploma or certificate;
  • the processing is based on LifeLiners’ legitimate interest.

LifeLiners’ legitimate interests are:

  • communications, to respond to your questions, requests and complaints;
  • compliance with ( foreign ) laws and regulations and /or any order of a ( foreign ) court, government, supervisory, regulatory or tax authority;
  • defend our interests in legal proceedings.

3.3. The data processed include:

  • identification data – first name, maiden name, last name, title, date of birth;
  • contact data – company name, company address, telephone number, e-mail address, name of contact person;
  • financial & transaction data – bank account, IBAN, VAT number.

3.4. You may, at your discretion, refuse to provide LifeLiners with some or all of the personal information requested by LifeLiners that is required for participation in Lifeliners’ courses and the release of a diploma or certificate of attendance. In this case, LifeLiners may not be able to provide these services.

3.5. If you provide LifeLiners with the personal data of third parties, you are obliged to inform these third parties of the processing of their data by LifeLiners and of the existence of the present privacy policy.

 

§ 4   DISCLOSURES OF YOUR PERSONAL DATA

4.1. Your personal data is processed by Lifeliners’ staff who are authorized to do so and who are subject to strict confidentiality obligations.

4.2. We may have to share your personal data with:

  • service providers who provide IT and system administration services;
  • professional advisers including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.

4.3. We may need to transfer your personal data to comply with applicable law or to respond to subpoenas, court orders or other legal process. This may involve sharing your data with law enforcement agencies, government agencies, courts and other organizations acting as separate data controllers.

 

§ 5   PROTECTION OF PERSONAL DATA

5.1. We have put in place appropriate organizational, physical and technical security measures (including in relation to our employees, facilities, hardware and software, storage and networks, access controls, monitoring and recording, vulnerability and breach detection, incident response) to prevent and where necessary manage unauthorized or accidental access, loss, alteration, disclosure or destruction of your personal data.

 

§ 6   RETENTION AND DESTRUCTION OF PERSONAL DATA

6.1. LifeLiners will retain your personal data for the duration of the agreement, service provision, any follow-up enrollments, course progress and history, duplicate requests and thereafter for a period of ten (10) years, unless longer or shorter statutory limitation periods apply.

6.2. Data collected in connection with an unsuccessful application will be deleted immediately or retained for 6 months if an offer can be made during this period.

6.3. Once LifeLiners no longer needs the personal data for the purposes for which it was collected, it will securely destroy it in accordance with applicable laws and regulations.

 

§ 7   RIGHTS TO PERSONAL DATA

7.1. In accordance with the conditions and limitations set out in the GDPR, you have the following rights:

  • access to your personal data;
  • rectification of your personal data if it is inaccurate or incomplete;
  • restriction to the use of your personal data;
  • erasure of your personal data when it is no longer necessary for the purposes for which it was collected;
  • for legitimate reasons object to the processing of your personal data, except where the processing of your data is mandatory;
  • request of personal data portability where technically possible;
  • withdraw your consent at any time.

7.2. Please note that these rights are not absolute and that we may not be able to respond positively to your requests in certain situations.

7.4. For disputes in this area, you also have the option of filing a complaint with the National Commission for Data Protection ( Commission Nationale pour la Protection des Données (“the CNPD”) ), headquartered at located at 15, Boulevard du Jazz, L-4370 Belvaux.

 

§ 8   CHANGES TO THIS POLICY

8.1. LifeLiners reserves the right to amend this privacy policy from time to time to reflect changes in the law, our data collection and use practices, and to ensure that it is accurate, complete and up to date*.
